Terms & Conditions

1. The submitting party must live within 50 miles of the Griffin-Spalding metropolitan area.　 OldHead R.A.D.I.Yo withholds the right to determine eligibility of an applicant’s claim to this assertion, and in rare cases we can make a special exception to this rule.

2. The submitting party is the sole owner of all copyrights and intellectual property rights associated with the material being submitted.　　 The submitting party / copyright owner must also agree that nothing submitted includes any content which infringes upon any copyright or any intellectual property right or trademark of any company, entity, or any person living or dead.　 The submitter recognizes and confirms that the submitter is solely legally responsible and accountable for the recorded material being submitted.

3. OldHead R.A.D.I.Yo has the right to use the submitted material, the CD cover art and liner notes associated with the submitted material completely royalty free for use in broadcasting, public play (for example: DJing at events, fund raisers and festivals), broadcast and store promotions, and the creation of CD compilations for fundraising purposes.　 Old Head Records, R.A.D.I.Yo, Inc. and TNT Productions, owners of OldHead R.A.D.I.Yo, its agents, its employees, its subcontractors and its board members are not subject to any royalty collection by any entity in relation to the music or material being submitted.　　 OldHead R.A.D.I.Yo has the right to broadcast all or only a selection of the material submitted, however all recordings will be available for download at the OldHead R.A.D.I.Yo website if so desired in accordance with program policy.　 OldHead R.A.D.I.Yo has the right to remove music from our OldHead R.A.D.I.Yo play list without warning or notification for any reason.

4. All material submitted broadcast and/or download must be original recordings that are written, produced, composed, and performed by the musicians, artists or performers submitting the recordings.　 No “Cover Music” is allowed even if you have rights to use it, only original music can be submitted.　 NO COVER MUSIC, NO EXCEPTIONS. If a submission contains Cover Music on the CD being submitted, please exclude that track from the Music Submission Form and only submit broadcast and/or download material.　 The submission of “Cover Music” as your own music will cause a rejection and removal of all of your music from scheduled broadcasts and online. (Cover music is considered any music not originally produced by the submitting artist, traditional music may be exempt if over 100 years old and proven to be in the public domain.)

5. The submitting party can request to have their recordings removed from broadcast play list　and from the online site through written submission.　 OldHead R.A.D.I.Yo has the right to continue broadcasting the material up to one month after receipt of the written request.　 Please send written requests to the address provided at the top of the page.

6. The submitting party must request to have their material withdrawn from the broadcast play list and online site when the submitter no longer solely controls the copyright to the recordings and materials provided. It is solely the responsibility of the submitter to notify OldHead R.A.D.I.Yo in writing in advance of any change in their ownership status as sole copyright owner and sole intellectual property owner of any recordings provided.　 Should a change in ownership occur, it is the responsibility of the submitter to notify the new owner of these terms and conditions. Old Head Records, R.A.D.I.Yo, Inc. and TNT Productions, owners of OldHead R.A.D.I.Yo, its agents, its employees, its subcontractors and its board members are not responsible for any royalties by any entity associated with any changes in ownership status of recordings and materials being submitted in this form without prior written notice of the change in ownership status.　 OldHead R.A.D.I.Yo holds the right to continue broadcasting the material royalty free up to one month after　the receipt of the written change in ownership status.

7.　 Terms subject to change without notice.

The purpose of OldHead R.A.D.I.Yo is to provide a venue / outlet for budding local and regional musicians, artists and performers so that their music, recordings and performances can be heard by the general public. 　OldHead R.A.D.I.Yo will never play music or recordings by　artists or　musicians　who have not signed a release with us to do so, and who are not from Spalding, Butts, Henry, Lamar, Pike, Upson, Coweta, Fayette, Clayton, Monroe, Meriwether and other neighboring counties.　 OldHead R.A.D.I.Yo will legally protect its right to broadcast　local original music, original recordings and original performances from local musicians, artist and performers.

Submitter attests that no　music, lyrics, poetry, written compositions, musical　compositions, literary readings, theatrical readings or recordings thereof submitted to OldHead R.A.D.I.Yo for broadcast and/or download does not infringe upon the copyrights or any intellectual property rights of any person, company or entity and thereby grants Old Head Records, R.A.D.I.Yo, Inc. and TNT Productions, owners of OldHead R.A.D.I.Yo, its agents, its employees, its subcontractors and its board members the right to use submitted material for OldHead R.A.D.I.Yo　broadcast and online audio streaming use. 　 All independent music played on this streaming　audio station is donated　by local artists,　performers, and musicians who are the sole copyright and intellectual property owners and creators of the original material.　　The submitting　artists, musicians and performers　have signed a Release Form stating such, and they have granted OldHead R.A.D.I.Yo the right to play said　material in whole or in part completely royalty free.　　Also, all program sound bits, promos, tags sound loops, and podcasts are created in-house by OldHead R.A.D.I.Yo and are the sole ownership of OldHead R.A.D.I.Yo.
